Pekes Childcare | Terms & Conditions

The document and the terms and conditions within it govern the basis on which PEKES LTD (referred to here as ‘we’ / ‘our’ / ‘us’ / ‘PEKES’ agree to provide childcare services to parent(s)/guardian(s) (referred to as ‘you’).

 

Only a parent/guardian with parental responsibility for a child can register that child for a childcare place with us. We will ask to see your child’s birth certificate, or other relevant documentation, to confirm that you have parental responsibility for the child as part of our registration process.

2. Hours of opening

[state opening hours, and any periods you are closed e.g. bank holidays, Christmas period]

3. Registration

In order to reserve a place for your child at PEKES , please complete and return the application (registration) form with a one off non-refundable [registration fee amount if applicable] registration fee made payable to PEKES for administration fees.

 

A [deposit amount if applicable] prior to commencement at PEKES.  This deposit will be refunded when the child permanently leaves the childcare, provided sufficient notice of four weeks has been given.  (See below for when sufficient notice has not been given)

4. Payment of Fees

The fees are payable each calendar month in advance by standing order and are calculated the number of days/hours your child will attend during the calendar month. 

 

Fees are due no later than the 1st of each month in advance payable to PEKES .  Late payment of fees or build up of arrears will constitute a breach of this contract. In some cases, we may “freeze” your child’s place. You will be given two weeks to clear the outstanding balance. Failure to do so will result in termination of the place with no allowance to attend at another time.


Fees will be reviewed every April in line with the following year’s financial projections.

5. Contracts

The contract is for the full year, which is approximately [weeks you are open] weeks. Each term shall automatically renew for subsequent period of the same length as the initial term unless either party gives the other written notice of termination at least [length of termination period] days prior to expiration of the current term

6. Delivery and Collection

Children must be placed in the care of a staff member and entered into the attendance register.  Children will not be released into the care of anyone other than those named on the record card unless authorised by the parents personally (see below for our child pick-up authorisation policy).

 

All parents and carers must sign their children out when exiting the setting.

A late collection fee operates within the setting with persistent late collection.  The fee for supervision of a child past the child's designated pick-up time shall be £10 for the first 20 minutes and £10 for each ten minutes after the initial 20-minute period.  This fee is assessed to compensate PEKES for additional staffing and overhead costs associated with late pick up. 

PEKES reserve the right to call children's social care for persistent late collection and/or if your children have not been collected an hour after the collection time agreed and stated in the welcome letter.

7. Changing to Hours and/or Days

If you wish to make any changes to the care your child is receiving, in regard to the amount of days or the specific days, this must be done a month in advance of the prospective change, and communicated to the Setting Manager

8. Clothing & Personal Hours

PEKES cannot be held responsible for the loss or damage of children’s property. Every reasonable effort will be made by staff to ensure the children’s belongings are not lost or damaged. Practical “inexpensive” clothing is strongly recommended. 

 

If PEKES finds it necessary to supply items for the children, which the carers are usually expected to provide, e.g. nappies, then a small charge will be made to cover the cost.

9. Absence

Parents are asked to notify the setting as early as possible if their child will be absent through holidays or sickness.  In the event of absence, we do not refund fees or offer alternative sessions.

10. Illness / Accidents

PEKES reserves the right to administer basic first aid and treatment when necessary. Parents will be informed of all accidents and will be required to sign their child’s accident form. For accidents of a more serious nature involving hospital treatment, all attempts will be made to contact parents, but failing this, PEKES is hereby authorised to act on behalf of the parents and authorise necessary treatment.  PEKES will administer prescribed medicine if parents complete a Medicine Consent form. All medicines must be taken home daily.


PEKES may require you to withdraw your child from the setting in the event that the child requires special medical care or attention which is not available, or which is refused by you or it is considered the child is not well enough to attend. You may also be required to withdraw your child if PEKES has a reasonable cause to believe that the child may be suffering or has suffered from any contagious disease and there remains a danger that other children at the setting may contract such a disease. PEKES have a realistic attitude to the needs of working parents but reserve the right to contact parents if their child becomes ill during our opening hours. If your child has had a sickness bug you are required to keep them away from the Setting for 48 hrs to exclude infection. Parents are requested to inform the setting if their child contracts any (normal childhood) ailments or illness.

11. Notice

One months notice must be given in writing when terminating a child care place. It is only possible to give notice once the child has been attending for one month, otherwise forfeiting the deposit.  Fees will be payable in relation to the one month notice period regardless of your child's attendance.  Any unpaid balance due at the end of the notice period will be deducted from the deposit.

12. Funding

As per government guidelines eligible two-year-olds and children over three (the term after their third birthday) are eligible for a free ‘15 hour’ government funded place per week.  At PEKES we spread funding over the whole year (as opposed to term time only), enabling you to access a free 11 hours per week.  Some three-year-olds are eligible for the 30 hours funding, as above we spread funding over the whole year enabling you to access 22 hours per week.  With 30 hours funding this must be applied for the term before hoping to start and must be re-applied for each term to stay eligible.

13. Records

All records relating to your child must be completed and returned to the setting prior to your child’s start date.  Parents/carers must inform the setting immediately of any changes of their contact details, or those of the emergency contact details given.

14. Publicity

Parents/carers should be aware that PEKES occasionally takes photographs within the setting, which may be used in training or promotional material. Should you wish that your child not be photographed, please let us know in writing at the time of registration.

15. Child Protection

The setting is under obligation to report to OFSTED/Area Child Protection Committee any incident where we consider a child may have been abused or neglected.  This may be done without informing the parent/carer.

16. Force Majeure Policy

There will be no refund or waiver of fees in the event that PEKES is closed or your child is released home early as a result of a force majeure event ( a force majeure event is any act of God, pandemic, closure of facility due to the recommendation of any Government Department or Body, war, strike, lockout, industrial action, fire, flood, drought, tempest or other event beyond the reasonable control of either party).

17. Staff Training

Throughout the year we may close the setting in order to have necessary staff training days.  Though this will occur usually no more than four times a year.  Advance notification of these days will be given.

18. Liability Limitations

Except in circumstances of death or personal injury caused by PEKES negligence, PEKES liability under or in connection with this contract whether arising in contract, tort, negligence, breach of statutory duty or otherwise howsoever shall not exceed the fees that you have paid PEKES .

19. Child Pick-up Authorisation

In order for an individual, other than the parent, to be picked up they must be authorised to do so, in advance and in writing, by parent and must be aware of the relevant security information associated with the child.

20. Liability Limitations

Except in circumstances of death or personal injury caused by PEKES negligence, PEKES liability under or in connection with this contract whether arising in contract, tort, negligence, breach of statutory duty or otherwise howsoever shall not exceed the fees that you have paid PEKES .

21. Termination of Contract

We have the right to terminate our contract with you with immediate effect and may ask you to remove your child from PEKES immediately if you, your child or any carer displays abusive, threatening, disruptive or otherwise inappropriate behaviour towards any member of staff, other child, parent/ carer or if you are in serious breach of these terms and conditions or if termination of a place is considered by us to be in the best interests of PEKES and/ or the continuing welfare of the other children at PEKES .  The setting has a written policy available to view on behaviour management.

22.Data Protection

Any personal information you supply to us will be collected, stored and used in accordance with the principles of the General Data Protection Regulations (GDPR) (2018) and our Confidentiality and Client Access to Records Policy. We will always seek your consent where we need to share information about your child with any other professional or agency. We are required by law to override your refusal to give consent only in specific circumstances where the child or someone in the family may be in danger if we/ do not share that information.

23. This Agreement

PEKES reserves the right to make amendments to terms and conditions.

 

This Agreement contains the full and complete understanding between the parties and supersedes all prior arrangements and understanding whether written or oral regarding this Agreement except to the extent that we vary terms from time to time.

 

Acceptance of a place will be deemed as acceptance by you of these terms and conditions.

24. Final Remarks

At PEKES our setting is committed to safeguarding and promoting the welfare of the Children, Young People and Adults at all times and expects everybody working within this setting to share this commitment.
